General provisions

These conditions are valid only between the company ABK Srl – Via Nomentana, 403 – 00162 Rome (Rm), P.I. 14036711001 below called "Mens et Manus" and any person who makes online purchases on the website hereafter referred to as "CUSTOMER". These conditions may be amended, the date of entry into line is equivalent to the date of entry into force.

These general conditions govern purchases made on the site, in accordance with Articles 50 and below of D. Lgs no. 206 of 6 September 2005, Consumer Code, Section II of Chapter I of Title Three of Part Three, to which reference is made as provided for in art. 60 of the Consumer Code.

ARTICLE 1 – Subject matter of the contract

With these general conditions of sale, "Mens et Manus" sells and the Customer remotely purchases the material movable goods indicated and offered for sale on the The contract ends exclusively through the internet, through the Customer's access to the address and the realization of a purchase order according to the procedure provided for by the site itself. The purchase order transmitted by the Customer through the site has the value of a contractual proposal and is governed by these general conditions of sale which, the Customer himself, is obliged to accept in full and without reservation.

ARTICLE 2 – Conclusion and effectiveness of the contract

The Customer, before the conclusion of the purchase contract, takes a look at the characteristics of the goods that are illustrated in the individual product sheets at the time of the customer's choice. The sale will be considered concluded with the sending by "Mens et Manus" to the Customer of an email confirming the order. The e-mail contains the customer's and order details, the price of the goods purchased, the transport costs and the shipping address to which the goods will be sent. The Customer undertakes to verify the correctness of the data contained in it and to promptly communicate any corrections.

"Mens et Manus" is committed to describing and presenting the items sold on the site in the best possible way. Despite this there may be some inaccuracies or small differences between the site and the actual product. Furthermore, photographs of the products not constitute a contractual element, as they are only representative.

"Mens et Manus" undertakes to deliver the goods within 30 days from the day following that of the customer's order confirmation.

ARTICLE 3 – Availability of products

The availability of the products indicated on the site refers to the actual availability at the time the Customer places the order. However, this availability must be considered indicative because, due to the simultaneous presence on the site of several users, the Products could be sold to other Customers before the order is confirmed.

Where the products subject to the order are not available for reasons independent of the will of "Mens et Manus" the order will be automatically adjusted with the elimination of the unavailable product.

ARTICLE 4 – Prices

All the sales prices of the products displayed and indicated on the are expressed in Euros and include VAT.

Shipping costs are not included in the purchase price but are indicated and calculated at the time of conclusion of the purchase process before the payment is made.

The Customer accepts the right of "Mens et Manus" to change its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site at the time of the order and confirmed in the e-mail sent by "Mens et Manus" as confirmation of the acquisition of the order.

ARTICLE 5 – Method of payment

Any payment by the Customer can only be made by means of the credit cards indicated on the and by bank transfer. For payments made by credit card, if the unavailability of a product is detected after the registration of the order and the reservation of the strut on the card, "Mens et Manus" will take the necessary measures with the payment operator to reverse the transaction relating to the unavailable goods. The actual charge of the order amount will only take place when it is complete and ready for shipment.

ARTICLE 6 – Right of withdrawal

In accordance with the legal provisions in force, the Customer has the right to withdraw from the purchase without any penalty within a period of 14 days, starting from the date of delivery of the products.

If the Customer decides to exercise this right, the goods must be returned intact, in the original packaging, complete in all its parts (including packaging and correctly completed return form) and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, "Mens et Manus" will refund the amount of the products subject to withdrawal in the shortest possible time and in any case within a maximum period of 30 days. The goods must be sent back to the reference craftsman who carried out the shipment.

As required by art. 56 paragraph 3 of D.Lgs 206/2005, modified by Legislative Decree 21/2014, the refund will be made only once the products have been received and verified. The refund will be made using the same method by which the Customer made the payment.

ARTICLE 7 – Delivery procedures

The products will be delivered via Corriere Espresso DHL to the address indicated by the Customer at the time of the order no later than 30 days from the date of receipt by the Customer of the order confirmation email sent.

ARTICLE 8 – Liability

"Mens et Manus" assumes no responsibility for disruptions attributable to force majeure or chance, even if dependent on malfunctions and disruptions of the internet, in the event that it fails to execute the order within the time allowed by the contract.

The availability of each item is only as an indication, is not contractual in nature and cannot be attributed to the seller responsible in case of unavailability of one or more products.

ARTICLE 9 – Access to the site

The Customer has the right to access the site for consultation and making purchases. No other use, particularly commercial, of the site or its content is permitted. The integrity of the elements of this site, whether sound or visual, and the related technology used remain the property of "Mens et Manus" and are protected by intellectual property rights.

ARTICLE 10 – Entirety

These General Terms of Sale consist of all the clauses that make them up. If one or more provisions of these General Terms of Sale are considered invalid or declared invalid under the law, regulation, or following a decision by a court with jurisdiction, the other provisions will continue to be fully effective and effective.

ARTICLE 11 – Final clauses

"Mens et Manus" reserves the right to modify these general conditions of sale at any time, at its discretion, without the need to provide any notice to users of the site. Any changes made will be effective from the date of publication on the site and will apply only to sales concluded from that date.

The prices, the products on sale on the Site and the characteristics of the same, are subject to change without notice.

ARTICLE 13 – Applicable law and competent jurisdiction

These General Terms of Sale are subject to Italian law. Any dispute that is not resolved amicably will be subject to the exclusive jurisdiction of the Court of the Customer's place of residence or domicile, if located in the territory of the State.
